There is delay of 160 days in instituting the Second Appeal. The reasons for the delay are ill-health of the applicant and that some time was spent in collecting all the relevant documents. A medical certificate is also filed along with the application seeking condonation of delay.

Accordingly, Misc. Civil Application No.599/2023 is disposed of. However, the pleadings in this application should be retained along with the main file because the parties have also pleaded about the issue of maintenance which may have to be considered when the appeal is taken up for admission. 5.

In the meantime, the learned counsel for the parties state that they will see if the parties can settle the matter between themselves.
