Learned Counsel for the appellant is not present in the Court.

Mr. Budhaji Gawade, learned Counsel appears on behalf of respondent nos.1 & 2 and states that the controversy in this appeal is already settled. He points out that the Bank had offered a one time settlement package to the appellant and in terms of the 3rd January 2022

11-FA-101-2019.DOC same the appellant has paid the necessary loan amount to the Bank. He submits that loan amount has also been duly closed. 3.

Having regard to the aforesaid, I am satisfied that the absence of the appellant or his Counsel is because the reliefs in this appeal have been rendered infructuous. This appeal is accordingly disposed of.

Civil Application no.141 of 2019 does not survive and the same is also disposed of.
