1. After hearing Mr. Agha learned counsel for the Petitioners and Mr. Sardessai learned Senior Counsel along with Mr. Siddharth Sardessai for the Respondents, Mr. Agha on instructions submits that the Petitioner be permitted to withdraw the present petition, however, some directions are required to be issued to the Mamlatdar at Ponda where the Mundkar Case No.1/2004 is still pending.

2. Mr. Sardessai submits that the Mamlatdar is not a party before this Court, however, the fact remains that such mundkar case is pending before the Mamlatdar wherein the Petitioner and the Respondent are parties.

3. Petitioner is permitted to withdraw the present petition.

4. Mamlatdar at Ponda is requested to expedite proceedings in Mundkar Case No.JM/I/REG/1/2004 pending between the Petitioner and the Respondent to be decided as expeditiously as possible and preferably within a period of 6 months from today.

5. Mr. Agha undertakes to place a copy of this Order before the concerned Mamlatdar on the next date.
