IN THE HIGH COURT OF BOMBAY AT GOA

WRIT PETITION NO. 708 OF 2015 DR.DAMODAR A. SARDESSAI., ... Petitioner

Versus

THE ASST. REGISTRAR OF CO-OPERATIVE SOCIETIES, CENTRAL ZONE AND 2 ORS., ... Respondents Mr. Sudin Usgaonkar, Senior Advocate with Ms. T. Ghanekar, Advocate for the Petitioner.

Mr. P. Faldessai, Additional Government Advocate for Respondent No.1.

Mr. C.K. Padgaonkar, Advocate for Respondent No.2. Coram:- F. M. REIS & K. L. WADANE, JJ.

Date:- 20th January, 2016 ORAL ORDER:

Heard Mr. Sudin Usgaonkar, the learned Senior Counsel appearing for the petitioner, Mr. P. Faldessai, the learned Additional Government Advocate appearing for the respondent no.1 and Mr. C. Padgaonkar, the learned Counsel appearing for the respondent no.2.

2. The only grievance raised by the petitioner at this stage is that the proceedings have been initiated before the learned Registrar/respondent no.1 for execution of an order passed by the Registrar/Cooperative Tribunal and that such proceedings which have been entertained by the respondent no.1 have not attained finality as they are still pending before the respondent no.1.

WP/708/2015

3. The learned Counsel appearing for the respondent no.2 has pointed out that according to the respondent no.2, he has already complied with the directions issued by the learned Registrar.

4. The learned Additional Government Advocate appearing for the respondent no.1 submits that the powers of the Registrar in such proceedings are very limited.

5. Without going into the merits of the rival contentions, we find that as the proceedings are still pending before the respondent no.1, it would be appropriate to dispose of such proceedings expeditiously after hearing the parties in accordance with law.

6. The learned Additional Government Advocate appearing for the respondent no.1 submits that such proceedings shall be disposed of within one month from today.

7. Accepting the said statement of the learned Additional Government Advocate appearing for the respondent no.1, we dispose of the above Writ petition. All contentions of the parties on merits are left open. The parties are directed to appear before the learned respondent no.1 on 27/01/2016 at 10.30 a.m.
