Shri Poulekar, the learned Counsel for the applicant has tendered the original Death Certificate of the applicant, who is said to have died on 27/10/2018. It is taken on record and marked 'X' for identification.

While suspending his sentence on 08/07/2015, this Court, inter alia, directed the applicant to furnish a PR Bond in the sum of ₹10,000/- with one surety and also to deposit compensation amount of ₹25,000/- in the Court of Additional Sessions Judge, Mapusa, as a condition precedent.

Shri Poulekar, the learned Counsel submits that the compensation of ₹25,000/- has already been deposited as per the order of this Court.

The legal heirs of the deceased are at liberty to apply for withdrawal of the amount of compensation as per the judgment and order of the Trial Court dated 13/11/2013. The learned Public Prosecutor Shri Rivankar submits that he shall ensure the release of the amount of compensation in favour of the legal heirs of the victim in Criminal Case No.96/S/2008. Since the applicant herein has died the petition stands abated and case stands disposed of. PRITHVIRAJ K. CHAVAN, J.
