Heard Mr. Poulekar, the learned counsel for the applicant. The applicant has been convicted for the offences punishable under Section 279 and 304-A of Indian Penal Code, and has been sentenced to undergo simple imprisonment for 30 days (under Section 279 of I.P.C.), and to undergo simple imprisonment for one year (under Section 304-A of I.P.C.), and further directed to pay compensation of Rs.25,000/- to the legal heirs of the deceased, and in default, to undergo simple imprisonment for three months. The said judgment and order has been confirmed in appeal.

2. It is submitted that the applicant was all along on bail and there are no allegations that he has misused the liberty. Considering the overall circumstances, the following order is passed :

CRMA/153/2015 : O r d e r :

i) The substantive sentence of imprisonment is hereby suspended, pending disposal of the criminal revision application, on condition of the applicant furnishing a P. R. Bond in the sum of Rs.10,000/-, with one solvent surety in the like amount, before the learned Additional Sessions Judge, Mapusa, and further subject to the condition that the amount of compensation Rs.25,000/- is deposited before the learned Additional Sessions Judge, Mapusa.

ii) Bail before the learned Additional Sessions Judge, Mapusa. iii) Parties to act upon the authenticated copy of this order. iv) The application is disposed of in the aforesaid terms. C. V. BHADANG, J.
