1. Heard learned Counsel for the Petitioner.

2. On instructions, he submits that the petition may be permitted to withdraw, however, he requests that time be granted to the Petitioner till October 2024 to examine the witness who is in the witness box along with another witness.

3. The learned Counsel for the Respondent fairly conceded that the matter is kept in the month of October 2024 and the evidence could be completed.

4. The permission is granted to withdraw the present petition. 7th August, 2024

WP 543 of 2024 However, the trial Court is requested to accommodate the parties in the month of October 2024 for completing evidence of the remaining witnesses. Accordingly, the date should be fixed for examining all the remaining witnesses. The learned Counsel for the Petitioner undertakes to complete the examination of witnesses by the end of October 2024 so that the suit could be disposed of by the end of December, 2024.

5. With these observations, the petition stands disposed of.
