2. The learned Public Prosecutor has no objection to condone the delay in filing the appeal since the applicant has been in custody through out, who came to be convicted by the Sessions Judge for the offence punishable under Section 22 (C) of NDPS Act and sentenced him R.I. for a period of 10 years and to pay fine of Rs.one lakh, in default to undergo simple imprisonment for a period of one year.

3. Considering the fact that the applicant has been in custody, delay of 20 days occurred in presenting the appeal stands condoned.
