This is an application to recall the conditional passed by this Court on 8/12/2016, directing the appellants to give clarification with regard to the office objections within two weeks and in case, no steps were taken within the stipulated period, the appeal would be dismissed without any further reference to the Court. The application is supported by an affidavit, inter alia, justifying the absence during the relevant period.

2. In the peculiar facts and circumstances of the case and as the appeal has already been admitted, I find that in the interest of

MCA/509/2017 justice, the order dated 4th January, 2017 passed by the Registrar, stands quashed and set aside, by condoning the delay of 180 days in filing the application for restoration. The applicants to clear all office objections within two weeks from today. In case the office objections are not cleared, the Registry to prepare the Paper Book excluding the documents not furnished from the list of documents.
