Heard Shri Desai, the learned Counsel for the applicant. None appears for the respondent, though served.

2. There is a delay of 799 days in filing the Criminal Revision Application. It is submitted that the applicant was not represented by a Counsel in the appeal before the learned Sessions Judge. It is submitted that the entire loan amount is paid and the Loan Account of the applicant is closed. It is submitted that the delay is neither intentional nor arising out of any negligence on the part of the applicant.

On hearing the learned Counsel for the applicant and for the reasons stated in the application and further, having regard to the fact that the application has gone uncontroverted, the same is allowed. The delay in filing the Criminal Revision Application is condoned. Let the Criminal Revision Application be registered.
