1. Since Mr Nadkarni, the learned Counsel representing Respondent No.6 has invited our attention to the foundation of the Petition filed by the components of Communidade of Serula, as it is pleaded that the Managing Committee of Communidade did not seem to be serious in pursuing the matter in respect of the structure standing in the property occupied by respondent no.6 and therefore the Petition is filed. He submit that the Communidade had already instituted a suit 16th April, 2025

WP 462 of 2024 against the Respondent No.6 bearing RCS No.103/2022 in which, the plaint is informed to be rejected on 10.05.2024, against which an appeal is preferred by the complainant which is presently pending.

2. On being confronted with the aforesaid situation, the learned Counsel for the Petitioner seeks permission to withdraw the Petition. The Petition stands dismissed as withdrawn.
