MISC.CIVIL APPLICATION NO. 744 OF 2016 IN FIRST APPEAL NO. 147 OF 2005 SHRI. RAM JANU DEIKAR (DEC) THR.
HIS LRS., ... Applicant
Versus
MRS. RUKMINIBAI PARSHURAM ACHARYA AND ANR., ... Respondents Shri Vishnuprasad A. Lawande, Advocate for the applicant. Shri R.G. Ramani, Advocate for the respondents no.1c and 1d. None for the respondents no.1a and 1b.
Coram:- NUTAN D. SARDESSAI, J.
Date:- 29th June, 2017 P.C.:
Shri R. G. Ramani, learned Advocate for the respondents no.1c and 1d in fairness conceded that he has no serious objection for the restoration of the appeal. Even otherwise, the applicant had set out in the application that due to the difficulty of the Advocate the matter could not be pursued and in that process the same came to be dismissed. These facts have not been controverted by any of the contesting respondents.
2. In view thereof, the application is allowed and the appeal is restored to file.
