Heard Mr. A. D. Bhobe, learned counsel for the Applicant and Mr. S. Redkar, learned counsel for the Respondents. 2.

On 13.09.2019, this Court made the following order :- "Learned Counsel for the parties submit that there are no serious objections to the appointment of an arbitrator in this matter. Accordingly, they leave it to this court to make such appointment.

This Court proposes to appoint Hon'ble Mr.Justice N.A. Britto, former Judge of this Court as an Arbitrator. In order to enable this Court to make such appointment, the matter is adjourned to 27th September, 2019, so that the

3. The learned Counsel for the parties state that they will hand over an authenticated copy of this order to the Hon'ble Mr. Justice N.A. Britto within a period of one week from today.

In pursuance of the aforesaid, the Hon'ble Mr. Justice N. A. Britto, the former Judge of this Court has filed a statement of disclosure indicating that he has no difficulties to take up this matter on arbitration. Accordingly, the Hon'ble Mr. Justice N. A. Britto, former Judge of this Court is appointed as Arbitrator to arbitrate into the dispute between the parties. 4.

The fees of the learned Arbitrator to be paid by the parties in terms of the provisions of the said Act and/or rules made thereunder.

The application for appointment of Arbitrator is disposed of in the aforesaid terms.

All concerned to act on the basis of the authenticated copy of this order.
