By an order dated 17.04.2017, this Court had granted interim stay in terms of prayer clause (b), subject to the petitioner depositing an amount of Rs.1,40,15,895/-, within eight weeks from the date of the order. The amount has been deposited on 11.07.2017, after a delay of about 24 days. This application is for condonation of the said delay.

2. On hearing the learned Counsel for the parties and for the reasons as mentioned in the application, the delay in depositing the amount is condoned.

The learned Counsel for the respondent points out that the petitioner has not complied with the order insofar as deposit of arrears from the date of the filing of the application till the passing of the order and has also failed to deposit the monthly rent on or before 7th of every month. He submits that he intends to file an application for modification of the order.

4. Liberty to file application for modification of the order, if so advised.

5. In the meantime, interim stay granted by order dated 17.04.2017 shall continue.
