....
Respondent Mr. A. D. Bhobe, Advocate for the Applicant.
Mr. J. Karn, Advocate for the Respondent.
Coram : N.M. Jamdar & Prithviraj K. Chavan, JJ.
Date : 18 September 2018.
P.C.:
The writ petition is of the year 2017 and since there are more older petitions pending on board, the request for early hearing cannot be considered at this stage. It is argued that the Applicant is working with the educational institution on the ground that the approval is not granted and no salary is paid. The learned counsel for the Applicant submits that non grant of approval does not mean that the responsibility on the educational institution to pay the teachers is
Amrut 2 MCA562-18dt 18-09-2018 not in existence, however, we do not find that the Applicant has made any representation to the educational institution to that effect. If the representation is so made by the Applicant and not considered, it is open to the Applicant, in the peculiar facts and circumstances of this case to take out an application in that regard to be considered on its own merits.
