The present Criminal Miscellaneous Application is placed before this Court as the Regular Court taking up the matter is not available today.

2. This is an application for suspension of sentence. The applicant has been convicted for the offence punishable under Section 20(b)(ii)(B) of the NDPS Act and has been sentenced to undergo simple imprisonment for a period of three years and to pay a fine of Rs.25,000/- and in default thereof to further undergo simple imprisonment for a period of six months. The applicant was on bail during the course of the trial.

3. On hearing the learned Counsel for the applicant and the learned Public Prosecutor for the respondent, the following order is passed:

O R D E R (a) The substantive sentence of imprisonment is hereby suspended, subject to the applicant furnishing a P.R. Bond in the sum of Rs.25,000/- alongwith one solvent surety in the like amount and on the applicant depositing the fine amount. (b) Bail bonds to be furnished and fine to be deposited before the learned Sessions Court.
