CRIMINAL REVISION APPLICATION NO. 5 OF 2018 HARISHCHANDRA CHODANKAR., ... Applicant

Versus

SUGANDHI S. GHATE @ SATYABHAMA H.

CHODANKAR., ... Respondent Shri Vivek Angelo Rodrigues, Advocate under Legal Aid Scheme for the petitioner.

Shri Deep D. Shirodkar, Advocate under Legal Aid Scheme for the respondent.

Coram:- C. V. BHADANG, J.

Date:- 17th October 2018 P.C.

Heard Shri Rodrigues, the learned Counsel for the petitioner and Shri Shirodkar, the learned Counsel for the respondent.

2. Brief facts, necessary for the disposal of the Revision Application, may be stated thus :

That the petitioner and the respondent are husband and wife. The respondent has filed proceedings under the Domestic Violence Act (the Act, for short) against the petitioner for various reliefs. The respondent also sought interim maintenance during the pendency of the application, which was refused by the learned Magistrate by an order dated 29/04/2015. That order was challenged by the respondent before the learned Sessions Judge in Criminal Appeal No.84/2015, which has been allowed by the learned Sessions Judge on 28/02/2017, granting interim

CRIR/5/2018 maintenance of Rs.5,000/- per month to the respondent. It is this order, which is the subject matter of challenge in this Revision Application.

3. Shri Rodrigues, the learned Counsel for the petitioner, in all fairness, states that the Main Application before the learned Magistrate is now fixed for evidence on 19/10/2018 and in view of the fact that the Main Application itself can be disposed of at an early date, this Court may pass appropriate orders in this Revision Application by expediting the application before the Magistrate.

4. In such circumstances, and in view of the fact that the Revision Application is yet to be admitted, the Criminal Revision Application is disposed of, with a direction to the learned Magistrate to decide the main application as expeditiously as possible and preferably by 31/01/2019. The parties to co-operate for the time bound disposal of the application. Rival contentions of the parties are left open. C. V. BHADANG, J.
