Heard Mr Padgaonkar, learned counsel for the petitioner, Ms Sulekha Kamat who holds for Ms Sapna Mordekar, learned Additional Government Advocate for respondent no.2 and Mr Ashwin Bhobe, learned counsel for respondent no.3.

2. Mr Padgaonkar placed on record communication dated 19.10.2022 issued by the Deputy Director of Tourism concerning the husband of the petitioner, late Mr Gajanan V. Kuwadekar.

He submits that in terms of this communication, it is clarified that the petitioner is entitled to avail Family Pension for service rendered by her husband in terms of Office Memorandum dated 08.04.1976. This communication requires the petitioner to re-submit her pension papers to the Home Department for disbursement of Family Pension.

3. Mr Padgaonkar, on instructions, states that with the above communication dated 19.10.2022, the petitioner's grievances, in particular, stands redressed. He states that the petitioner will now re-submit the pension papers to the Home Department for disbursement of her Family Pension within maximum 2 weeks from today. He submit that some directions may be issued to respondent no.1 and 2 to process the same at the earliest.

4. Accordingly, we dispose of this petition by directing respondent no.1 and 2 to process the petitioner's re-submitted request for disbursement of Family Pension in accord with the communication dated 19.10.2022. The pension papers must be processed within 3 months from the date of their receipt.

5. With the above directions, this petition is disposed of. There shall be no order for costs.
