The challenge in this petition is to the order dated 24.04.2017, dismissing the application filed by the petitioner/plaintiff under Order XXXIX, Rule 7 of the Code of Civil Procedure (Code, for short) for appointment of a Commissioner to visit the suit premises, to inspect the same and report about its condition and enclosing the photographs of the suit premises.

2. The learned Counsel for the petitioner states that since after the filing of the petition, the respondent has furnished the photographs of the suit premises to the petitioner. Hence, nothing survives in the petition.
