Heard Mr. Vivek Rodrigues, learned Counsel appearing for the Applicant and Mr. Amogh Prabhudessai, learned Addl. Goverment Advocate appearing for the Respondents.
2. This is an application for speaking to the minutes to correct the typographical error which has arisen at para 12 of the Judgment dated 26.04.2017.
3. It is pointed out by Shri Rodrigues, learned Counsel appearing for the Applicant, that in Para 12 at line 6, the word "petitioners" has to be substituted by the word "respondents".
MCA/602/2017 Learned Counsel has also pointed out that recovery of the amount by the Respondents have been quashed and set aside which does not reflect in the operative part of the said Order.
4. As far as the correction of the mistake is concerned, no doubt, by typographical error, the word "petitioners" has been added instead of the word "respondents". The correction to that effect is allowed. Registry to act accordingly.
5. As far as the next contention of Mr. Rodrigues, learned Counsel appearing for the Applicant is concerned, the Order is very clear that the recovery is quashed and set aside, such aspect would have to be read in para 13(ii) wherein this Court has clearly observed that the amounts would have to be paid in the light of the observations made herein above.
6. Hence, Application stands disposed of.
