This Tax Appeal is filed by the Commissioner of Income Tax challenging an order passed by the Income Tax Appellate Tribunal. The tax effect of the appeal being less than Rs.50 lakhs, learned Standing counsel on behalf of the Appellant Commissioner of Income Tax seeks leave to withdraw the appeal on instructions. Learned counsel places on record a copy of the written instructions issued to her in this behalf by the department. The instructions issued by the department are kept on file and marked 'X' for identification. Tax Appeal No.77 of 2014 is accordingly dismissed as withdrawn.
