Heard Mr P.A. Kamat, learned Counsel for the Petitioner and Mr Amogh Arlekar, learned Addl. Govt. Advocate for Respondents No.1 and 3.

In view of the proposed order, requirement of issuance of notice to Respondent No.2 is hereby dispensed with.

By instituting these proceedings under Article 226 of the Constitution of India, a direction has been sought to be issued to Respondent No.1 to implement an order dated 04/04/2017, whereby certain structures were ordered to be demolished and also for restoring the land to its original condition. The order dated 04/04/2017 passed by Respondent No.1, further directs that in case the demolition, as ordered, does not take place and the land is not restored, in that eventuality the Deputy Collector & S.D.O. of Bardez will verity the structures and ensure that they are removed/demolished.

On instruction, learned Addl. Govt. Advocate representing Respondent No.1 has submitted that a requisition has been sent yesterday by Respondent No.3 for executing the order dated 04/04/2017.

In view of the aforesaid, we dispose of this Writ Petition, with a direction to Respondent No.3 to act upon the requisition made by it and ensure the compliance of its order dated 04/04/4017 with expeditious say, within a period of one month from today. We further provide that in case Respondent No.3 is faced with any difficulty in implementing the order dated 04/04/2017 and requires some Police assistance, requisite police assistance shall also be provided in order to ensure

compliance of the order dated 04/04/2017 passed by Respondent No.1 6.

With the aforesaid observations, the Writ Petition is finally disposed of BHARAT P. DESHPANDE, J.
