2. Ms. Amira Razaq, the learned Standing Counsel for the appellant-Department, informs us that in view of the later developments the appeal no longer survives. According to her, the Department has already filed on record pursis along with a letter from the Department informing that the matter has already been settled. She wants the Court to take that departmental letter on file and close the appeal.

3. On the other hand, Shri P. Karpe, the learned counsel for the respondent, informs us that he has already filed on record Form No.3 and Form No.5.

4. Under these circumstances, after taking those records on file, we close the Tax Appeal, as infructuous.
