Considering this fair position taken by the petitioner, the Petition is allowed to be withdrawn.

It is however clarified that in the event, if there are any other pending proceedings, the same shall be decided on their own merits and without being influenced by the observations as made in the impugned order. All contentions of the parties in the pending proceedings, if any, are expressly kept open. 5.

While parting with the present proceedings, it may be observed that both the parties need to take a fair stand and bring about an amicable resolution of the disputes. It is certainly not in the interest of both the parties that they spend their valuable time and resources in litigation 6.

Disposed of. No costs.

Miscellaneous Civil Application No. 337/2022 would not survive and the same stands disposed of.
