This is an application for withdrawal of the amount by the original claimant, who is the respondent no.1 in the appeal.
2. The first respondent, Insurance company in this application has filed a reply stating that the respondent has no objection for withdrawal of 50% of the amount deposited before this Court. The record shows that the First Appeal is dismissed for want of compliance with the office objections and the respondent no.1 has filed Civil Application Stamp no.2235/2018 for restoration of the appeal. Be that as it may, the respondent no.1 has
MCA/810/2018 deposited an amount of Rs.21,72,054/- before this Court on 16/10/2017.
3. On hearing the learned counsel for the parties, the applicant is allowed to withdraw an amount of Rs.10 lakhs (Rupees Ten lakhs only) from the amount deposited before this Court. The remaining amount shall continue to stay invested in a nationalized bank.
4. The Civil Application is disposed off in the aforesaid terms. C. V. BHADANG, J.
