Since it is alleged that the construction activity has been undertaken as depicted in the photographs which is beyond the mundkarial area of 361 sq.mts. and taking into consideration the order dated 28/03/2011, it would be appropriate that the matter is remitted to the Trial Court for conducting an enquiry and submitting its report within three months.

2. In view thereof, the matter is remitted to the Trial Court to hold an enquiry and conclude the same within a period of six months from the receipt of the order.
