Heard Shri Y. V. Nadkarni, learned Counsel appearing for the Petitioners, Mr. Shivan Desai, learned Counsel appearing for the Respondent-Company for winding up and Ms. Amira Razaq, learned Counsel for the Official Liquidator.

2. By an Order dated 09.07.2014, the above winding up Petition came to be admitted and a provisional Official Liquidator was also appointed. The Petitioner is an unsecured creditor. Whilst passing such Order, it was noted, prima facie, that the claim of the Petitioner was not disputed by the Company in liquidation. After the admission of the above Petition, the Respondent has not filed any reply opposing the Order to winding up initial proceedings. In such circumstances, the averments in the Petition stand uncontroverted.

3. For the aforesaid reasons, I pass the following :

ORDER

(i) The Respondent-Company is directed to be wound up in accordance with law.

(ii) The Official Liquidator of the High Court of Bombay at Goa is appointed as a Liquidator to carry out such exercise.
