In the result, the Appeal is allowed.

(i) The impugned order dated 29/07/2015 is hereby set aside. (ii) The matter is sent back to the learned Trial Court. (iii) The parties to appear before the Trial Court on 04/09/2015. (iv) The learned Trial Court shall decide the application as expeditiously as possible and preferably within a period of one week from 04/09/2015, after granting opportunity of hearing to the parties and in accordance with law.
