Heard Mr. A. D. Bhobe, learned counsel for the applicant. 2.

On 8th December 2021, this Court made the following order:- "When the application is called out for hearing, Mr. Bhobe, learned Counsel appearing for the Applicant, confirms the fact that the Applicant (original Accused) expired. He further submitted that beyond furnishing the death certificate of the Applicant, his legal representatives have not indicated as to whether they wish to pursue the present application. He submits that he would send a communication to the available address to the legal heirs of the deceased-Applicant to seek instructions as to whether they wish to pursue the present application. 21st January 2022

2. In the meanwhile, learned Counsel appearing for the Respondent no.2 submits that in these circumstances, the amount deposited by the deceased-Applicant before the Sessions Court and this Court, may be directed to be released.

3. The prayer made on behalf of Respondent no.2 appears to be reasonable.

4. Hence, list this application for further consideration on 19.01.2022.

5. In the meanwhile, the amount deposited by the deceased Applicant in the Sessions Court and this Court shall be released in favour of Respondent no.2 along with accrued interest, if any."

Today, Mr. A. D. Bhobe submits that he made attempts to contact the legal representatives but he has not been able to receive any instructions from them.

Notice as well as the envelope containing notice addressed by Mr. Bhobe is taken on record.

Now that the applicant has already expired, this revision is disposed of.
