2. It is submitted by the learned Counsel for the applicant that the first appeal was dismissed in default vide order dated 31.01.2014. The above first appeal was dismissed on account of conditional order dated 31.01.2014 for non supplying of copies of the proceedings of the appeal.

3. Having regard to the circumstances and for the reasons mentioned in the application, the application is allowed. First Appeal No. 327/2007, is restored back to the file. The dismissal of the appeal as against respondent nos. 1 and 3 (in appeal), is set aside.
