Heard learned Counsel for the parties.
2. The complaint filed by the applicant has been dismissed and the respondent has been acquitted on the ground that Mr. Ramakant Parab, who has signed the complaint was not duly authorised by the complainant Bank. However, it appears that the letter of authority was produced which is on record.
3. Considering the limited issue involved it would be necessary to grant leave to appeal against acquittal. Application is accordingly allowed. The office shall register the appeal and the same shall be treated as admitted. The learned Magistrate to take action under
CRMA/208/2015 Section 390 of the Criminal Procedure Code.
