Heard Mr. U. R. Timble, learned counsel appearing for the applicants and Mr. A. Gaokar, learned counsel appearing for the respondents.
2. This is an application to substitute the respondent no.1 by the Reconstruction company to whom the financial assets have been transferred. The learned counsel appearing for the original appellant opposes the said application as according to him, the respondent no.1 is necessary party to the appeal considering the nature of the dispute in the above appeal.
3. Mr. Timble, learned counsel appearing for the applicants
MCA/520/2015 however points out that in the alternative the Reconstruction company may be impleaded as party respondent to the above appeal.
4. In the facts and circumstances of the case and considering the nature of the reliefs sought in the above appeal, I find that the Reconstruction company may be impleaded as respondent no.3. Amendment to be carried out forthwith.
5. Mr. Timble, learned counsel waives service on behalf of the newly added respondent no.3.
