Heard Mr. Supekar, learned Advocate appearing for the applicant and Mr.S.D.Lotlikar, learned Senior Advocate appearing for the petitioners.

This is an application filed by the applicant inter alia contending that during the pendency of the above petition, the subject Vessel was disposed of and the purchaser be accordingly substituted. Mr. Lotlikar, learned Senior Advocate opposes the said application and according to him, question of substitution would not arise as the petition has been filed when the applicant was admittedly not the owner of the subject vessel.

In the peculiar facts and circumstances of the case and considering

MCA/821/2015 the relief sought in the petition, the question of seeking substitution the name of the applicant, at this stage, will not be appropriate. The application stands accordingly disposed of. K. L. WADANE, J.
