2. During the course of hearing of the above petition, the learned Public Prosecutor Mr. S. R. Rivonkar, upon instructions, states that the respondent-Prosecution shall not act upon the impugned Notice dated 24th July, 2015 as the petitioners have been joined as accused in the F.I.R..

3. Statement made by the learned Public Prosecutor is accepted.

WPCR/104/2015 In such circumstances, the question of proceeding with the above writ petition, at this stage, does not arise at all.

4. The petition stands disposed of accordingly. Needless to say, all contentions of both the parties, on merits, are left open. K. L. WADANE, J.
