Mr Athnain Naik, the learned counsel for the petitioner, fairly points out that the reliefs in this petition have become infructuous because the plaint in Civil Suit No.70/2012 in which the impugned order was made has been rejected by order dated 22.11.2024.

2. Accordingly, this petition is disposed of. However, liberty is granted to the petitioner to challenge the impugned order in case the petitioner decides to appeal the order dated 22.11.2024.
