After hearing the matter for some time, it was pointed out by Mr. J.A. Lobo, learned Counsel appearing for the petitioners submits that even assuming the reports of the Range Forest Officer and Mamlatdar are taken into consideration only some branches of the subject tree would meet the apprehensions of respondent no.1.

2. In such circumstances, liberty to the petitioners to move the respondent no.2, the learned Deputy Collector on or before 10/08/2015 and in case any such application is filed, the learned Deputy Collector shall examine such application after hearing the concerned parties in accordance with law.

3. Subject to the above, the petition stands disposed of. Parties to act on the authenticated copy of this order.
