Shri J. Godinho, the learned Counsel for the petitioner states that the present application seeks restoration of the application under Stamp no.1265/2014 which was filed for early hearing of the appeal.

2. Shri Godinho, states that he will not press the present Civil Revision Application, if Court could consider expediting the hearing of the Second Appeal No.85/2007. Shri Godinho states that the appeals of the year 2007 are already on board for hearing and the petitioner is a senior citizen of 85 years.

3. Accordingly, the Civil Revision Application is disposed of as not pressed. Registry to place the Second Appeal on board of final hearing as per its turn as 2007 appeals are already on board. N. M. JAMDAR, J.
