Heard Mr Lopes, learned counsel for the Applicant, Mr Redkar, learned counsel for Respondent No.1 and Mr Halarnkar, learned counsel for Respondent No.3.

2. There is a delay of 151 days in instituting this appeal. The delay is sufficiently explained. Mr Halarnkar points out that only explanation relates to the movement of file from one table to other. From the perusal of the application, the movement of file from one table to other is one of the reasons. There are other reasons concerning the officials who had some difficulties in processing the matter. There were also some changes of officials who were dealing with the file. The delay is 4th January, 2024

MCA 390 of 2023 also not inordinate and there is no lack of bonafide.

3. On cumulative consideration of all these circumstances, the delay is condoned.
