It is not disputed by the learned Counsel appearing for the petitioner that identical issue raised in the Writ Petition No. 779/2016 which came to be disposed off by an order passed today i.e.15.11.2016.

2. For the reasons stated in the said order, I find that there is no jurisdictional error committed by the learned Judge while passing the order impugned which would call for any inference of this Court as there is no failure of justice in case the impugned order is allowed to stand.

3. Needless to say that the learned Judge would consider the application for leave to appeal after hearing the parties in accordance with law. Subject to the above petition stands rejected. F. M. REIS, J.
