2. The learned Counsel for the petitioners, on instructions, seeks permission to withdraw the writ petition.

3. The petition is, accordingly, disposed of as withdrawn, with no order as to costs.

4. Needless to mention that it would be open for the Trial Court to independently consider on its own whether the suit is bad for non-joinder of necessary parties, at the time of final disposal of the

WP/732/2016 suit. In the event the Court finds it necessary to consider this issue, it shall decide the same without being influenced by the observations in the impugned order.
