By this application, the applicant is seeking suspension of sentence imposed by the Magistrate. It is pointed out that during the pendency of the appeal before the Session Court, the applicant had deposited an amount of Rs.1,41,000/-, which is still lying in deposit.

It is further submitted that the applicant is ready to deposit further amount as pre-condition for suspension of sentence. 3.

Considering the fact that the Magistrate directed payment of compensation of Rs.5,64,000/- to the respondent, it would be in the interest of justice that the applicant deposits a further amount of Rs.1,09,000/- (Rupees One lakh nine thousand only) before the Sessions Court as a pre -condition for suspension of sentence.

In view of the above, this application is disposed of by suspending the sentence imposed on the applicant subject to the applicant depositing an amount of Rs.1,09,000/- before the concerned Sessions Court within a period of six weeks from today.

It is made clear that if the amount is not deposited within the stipulated period of time, the present order shall stand withdrawn and the application for suspension of sentence shall stand dismissed.
