On 14/07/2016 "Rule" was issued in the Writ Petition and the ad-interim relief came to be granted. 2.

By MCA No.722 of 2019, the applicant Ms. Sweta Mayekar through her attorney Mr. Anil Raghuvir Hoble has taken out an application seeking an intervention in view of the claim that she is the owner of the property and any order passed in the proceedings would have a direct bearing on her rights and interest.

2 28 MCA 722 OF 2018 The application is opposed by the learned Counsel for the petitioner on the ground that in the proceedings before the lower Court, no attempt was made to intervene and therefore at this stage when it is pending for adjudication before this Court, the applicant cannot jump into proceedings.

Perused the application and also heard the respective Counsel for the petitioner as well as Counsel for the respondent. 4.

Since the applicant claim to possess an interest in the said property, it would be appropriate and in the interest of justice to permit the applicant to intervene in the matter. The Misc Civil Application No.722 of 2019 is made absolute in terms of prayer clause '

a'. As far as the prayer 'b' is concerned, that would be considered independently. The petitioner is directed to carry out the necessary amendment within a period of two weeks . 5.

List the matter as per the scheduled date of final hearing.

Misc Civil Application stands disposed of.
