Heard learned Counsel for the applicant and the learned Special Public Prosecutor for the respondents.

2. The applicant has been arrested in connection with investigation of Crime No.RC3(A)/2016/CBI/ACB-GOA under Section 7 of Prevention of Corruption Act, 1988. The case of the prosecution is that the applicant had demanded illegal gratification of Rs.7,000/- and had accepted the illegal gratification of Rs.5,000/- for giving favourable report for extension of canteen contract to the complainant. The applicant happens to be the Medical Officer attached to the Port Health Organization.

3. On hearing the learned Counsel for the applicant and the learned

CRMAB/155/2016 Special Public Prosecutor, it appears that, at this stage, the only offence registered is one under Section 7 of the Prevention of Corruption Act. In such circumstances, the learned Special Public Prosecutor fairly submits that the applicant may be directed to report to the Investigating Agency on ten working days from Monday, 08/08/2016 from 10.00 a.m. to 1.00 p.m.

4. In view of this, the following order is passed: (i) The applicant shall be released on bail on executing a PR bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The applicant shall attend the office of the Investigating Officer on working days from Monday, 08/08/2016 to 22/08/2016 from 10.00a.m. to 1.00 p.m. and as and when required by the Investigating Agency.

(iii) The applicant shall co-operate with the Investigating Agency in the matter of investigation and shall not tamper or influence the prosecution witnesses.

(iv) In the event of breach, liberty to the prosecution to move for cancellation.
