CORAM:

DATED:
ORAL ORDER:
1.
This is an application for confirmation of a Foreign Judgment/Decree granting Divorce to the Petitioner. The application has been filed under Article 1101 of the Portuguese Civil Procedure Code read with Section 13 of the Civil Procedure Code. 2.
The Respondent was served and has appeared in person submitting that she has no objection to the grant of the application and to the cancellation of the entry of marriage in the Marriage Register maintained by the Civil Registrar, Tiswadi at Panaji. 3.
The parties had registered their marriage before the Civil Registration Office of Tiswadi, Panaji, North Goa, and an entry to that effect has been made under No.492 of 2020 dated 28.10.2020 in the Marriage Registration book of the year 2020. 4.
Due to differences that arose between the parties, the Applicant filed proceedings for dissolution of marriage registered in Goa, before the Family Court at HM Courts & Tribunals service, PO Box 13226, Harlow, CM20 9UG, United Kingdom bearing Case No.1713-78461518-1315 and vide order dated 17.12.2024, a conditional order was passed. At the relevant time, the parties were residing in United Kingdom.
5.
By a Final Order dated 07.03.2025, passed by the HM Courts
& Tribunals service, PO Box 13226, Harlow, CM20 9UG, United Kingdom, the conditional order was made final, recording that no sufficient cause for refusing to grant the final order was shown to the Court. A Certificate of Final Order (Divorce) was issued to that effect.
6.
On perusing the conditions of the Final Order passed, the same does not appear to be a Judgment passed based on law contrary to the Public Policy of India and appears to conform with the laws of the land, as would be applicable to the parties, within the State of Goa. Consequently, the application is allowed. The order has been passed after issuing notice to the Respondent, who has today acknowledged that she is aware of the order sought to be confirmed. The Final Order dated 07.03.2025 passed by the HM Courts & Tribunals service, United Kingdom is confirmed and held as final and conclusive. 7.
The marriage of the Petitioner with the Respondent shall stand dissolved on the confirmation of this Foreign Decree. Consequently, the Civil Registrar is directed to make appropriate endorsement against the Entry No. No.492 of 2020 dated 28.10.2020 in the Marriage Registration book of the year 2020, recording confirmation of the aforementioned Decree of Divorce and cancel such registration.
8.
The order is made absolute in the above terms.
9.
The present application stands disposed of.
