Heard Shri Talaulikar, the learned counsel for the petitioners and Shri Lotlikar, the learned Senior Counsel for the Respondent nos.1(a)to (d) who are the contesting respondents.
2. The learned counsel for the petitioners states that a draft in the sum of Rs.3.00 lakhs is drawn and shall be handed to the learned counsel for the respondent during the course of the day. The statement is accepted.
3. Thus, by consent of parties, the petition is disposed off in the following terms:
(i) The impugned order is hereby set aside.
WP/687/2017 (ii) The petitioners shall hand over the draft of Rs.3.00 lakhs to the learned counsel for the respondent during the course of the day.
(iii) The petitioners are directed to pay a further amount of Rs.3.00 lakhs to the respondent by 30/11/2017. (iv) Needless to mention that the Executing Court shall decide on the question of the amount due, if any, from the petitioners and on the aspect of delivery of possession in accordance with law. (v) The petition is disposed of in the aforesaid terms with no order as to costs.
