Mr. Prakash Desai, Secretary of Village Panchayat Pilgao, has filed an affidavit before us stating that the Show Cause Notice has already been disposed of culminating into the issue of demolition order on 13th October 2022.

A photocopy of the demolition order is today furnished to Mr. Godinho.

In this case, the Panchayat failed to take action within the time indicated by us in our order. The Panchayat also did not bothered to seek 19th October, 2022

8 CP-17-2022.DOC any extension of time. The petitioner was forced to file this Contempt Petition and it is only after that the order of demotion has been made. Therefore, we are inclined to impose some costs on the Secretary. However, Mr. Naik explained that the Secretary had placed the matter before the Panchayat. Only some members of the Panchayat failed to take action within time and proposed regularization. He submits that there is no delay on the part of the Secretary.

Prima facie, this is a case where the Panchayat members have not complied with our order within the time line indicated. However, now it is pointed out that there is a change in the composition of the Panchayat. Accordingly, we leave the matter at that and dispose of this Contempt Petition by accepting the apology.

The Contempt Petition stands disposed of.
