The petitioner is the original plaintiff, whose application for extension of time to file written statement to the counterclaim, filed by the respondent, is rejected.

2. Undisputedly, the application (Exhibit-16), for extension of time to file written statement was filed within a period of 90 days, from the date of filing of the counterclaim. On hearing the learned Counsel for the parties, I find that a case for grant of time to file the written statement is made out by the petitioner.

3. In that view of the matter, the impugned order is hereby set aside. The petitioner is permitted to file the written statement to the counterclaim. The learned Counsel for the petitioner, on instructions, undertakes to file the written statement, within two

WP/953/2018 weeks from today. The parties to appear before the Trial Court on 20.12.2018 at 2:30 p.m. The petition is disposed of. C. V. BHADANG, J.
