After hearing the learned Advocate appearing on behalf of the Appellants, when I was not inclined to entertain the above Appeal, the learned Counsel, on instructions from Appellant No. 2 who is present in the Court, sought leave to unconditionally withdraw the above Appeal.

2. In these circumstances, the Appeal is dismissed as withdrawn. No order as to costs. It is clarified that any 14th February, 2023

AO 22 of 2022 observations made by the Trial Court in the impugned order are to be treated as only prima facie.

3. The Appeal is accordingly disposed of.

4. In view of the disposal of the Appeal, nothing survives in the above Civil Application and the same is disposed of accordingly.
