2. Shri De Sa, the learned Counsel for the applicant seeks leave to withdraw the application with liberty to move the learned Sessions Judge afresh, after the examination of material witnesses, namely Sandesh Naik, Sunil Mulgaonkar, Sudesh Kamurlekar, Shiva Rathod and Mahadeo Morajkar.

3. The learned Additional Public Prosecutor has no objection for the same.

4. In such circumstances, the criminal application is disposed of as withdrawn, with liberty as prayed.

5. It is made clear that if the applicant approaches the learned Sessions Judge afresh for bail, after the examination of aforesaid

CRMAB/236/2018 material witnesses, the learned Sessions Judge shall decide the application on its own merits and in accordance with law.

6. Needless to mention that being a custody trial, the learned Sessions Judge shall proceed with the trial as expeditiously as possible.
