On hearing the learned Counsel for the petitioner and the learned Government Advocate for the respondents and for reasons as mentioned in the judgment, dismissing W.P. No.771/2016, I do not find that any case for interference is made out.

2. However, the learned Government Advocate, on instructions from Shri Diogo Fernandes, Commercial Tax Officer, who is present before the Court, states that the amount of Rs.62,916/-, deposited by the petitioner on 31/07/2009, has not been taken into consideration in the best assessment order. The learned Government Advocate states that the respondents shall allow the

WP/770/2016 credit of the said amount along with proportionate interest and penalty, if any and shall issue a revised assessment order accordingly, within a period of two weeks from today. The statement is accepted. Subject to this, the petition is disposed of, with no order as to costs.
